
HIPAA PRE-EMPTION ANALYSIS FOR VIRGINIA 12/1/02

In conjunction with other healthcare provider associations, the Virginia Health Care Association retained Troutman Sanders LLP to conduct a HIPAA Privacy pre-emption analysis for Virginia. This member service is offered to assist providers in understanding the complexities in reconciling duties and obligations under Virginia law with those imposed by HIPAAs privacy rules. Troutman Sanders LLP is a major national and international law firm with substantial health care expertise. Troutman Sanders has prepared a HIPAA pre-emption analysis that compares and contrasts the legal obligations imposed by the HIPAA privacy rule with Virginia laws on confidentiality governing health care providers. In their analysis, Troutman Sanders provides guidance for VHCA members and other health care providers on what actions they need to take to be compliant from the HIPAA pre-emption perspective.
