
DSS Posts Regulatory Package Addressing AG Changes

In early May, the Department of Social Services (DSS) distributed a letter to providers addressing reporting requirements for facilities that accept Auxiliary Grant (AG) residents. That letter communicated a new reporting form and temporary procedures modifying regulations which took effect August 1, 2007 that required a financial audit. As previously announced, DSS is pursuing fast-track regulatory changes that will permanently address the audit requirements related to the Auxiliary Grant Program. Late last week, the DSS website was updated to include the fast-track regulatory approval request by DSS Commissioner Anthony Conyers. The proposed amendments to 22VAC40-25 remove the requirement for assisted living facilities with 20 or more residents to submit an annual audit report and replace it with a requirement that administrators of all assisted living facilities complete, sign and submit an annual AG certification report. The report includes general resident census and financial information and a statement certifying that the facility properly handles and accounts for AG recipients’ personal needs allowances and is in compliance with applicable AG program and the Department of Social Services’ licensing regulations. The fact-track regulatory package is available here. Our understanding is that the Board of the Department of Social Services will vote on the request at its June 18th meeting. This action will be followed by a 60-day public comment period. If no one objects to this action during public comment, the new regulations will become effective 15 days after the close of the comment period.
